Terms of Service for Web Accounts
This agreement documents the terms of service for web accounts provided by StellarHost.Com to the account holder.
- The account holder is responsible for the actions of account users and all must abide by the Acceptable Use Policy.
- Should the account holder become the target of a network attack, StellarHost.Com reserves the right to take any necessary actions (including, but not limited to, temporary suspension of the account holder's account) required to return server or network operation to normal.
- StellarHost.Com will use its best efforts to maintain, but does not guarantee, the privacy of email, network use, and the contents of user directories.
- Use of StellarHost.Com services, including the storage of information, is at the account holder's sole risk. StellarHost.Com does not warrant either the results to be obtained from the service or that the service will be uninterrupted or error free. StellarHost.Com's services are provided on an "as is" basis without warranties of any kind, either express or implied. Neither StellarHost.Com nor anyone else involved in creating, producing, or delivering StellarHost.Com services shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of StellarHost.Com services, the inability to use StellarHost.Com service, or any breach of any warranty. The provisions of this paragraph will survive termination of this agreement.
- The account holder will indemnify and hold harmless StellarHost.Com against any loss, damage, cost and expense which StellarHost.Com may incur or become liable for by reason of claims or actions for libel, violation of privacy rights, plagiarism, copyright infringement, and claims arising in connection with data transmitted pursuant to the terms and provisions of this agreement and any claims or suits resulting from the account holder's use of the service including, without limitation, the expense and cost of defending any and all such claims and actions, except where such claims result solely from the negligence of TWIC, Inc's failure to perform its obligations under this agreement. The provisions of this paragraph shall survive termination of this agreement.
- If StellarHost.Com is informed of an alleged copyright or trademark infringement involving an account, StellarHost.Com will attempt to notify the account holder of those allegations and secure a response. StellarHost.Com may, in its sole discretion, remove or terminate the account containing, on a temporary or permanent basis, materials which StellarHost.Com believes may create, constitute, or contribute to copyright or trademark infringements. Account holder expressly waives the right to assert any claims against StellarHost.Com for any such removal or termination.
- Customer agrees to a thirty (30) day contract minimum (or twelve (12) month contract depending on length of pre-payment), beginning upon commencement of service. The first month will be prorated to the first day of the following month and accounts will be invoice on the first of every month.
- All of StellarHost.Com's web hosting plans have a 30 day money back guarantee. If for any reason you are not completely satisfied with our services within the first 30 days of your account you will be refunded your full amount of your web site hosting fee excluding any setup fee that was obtained. No refund will be given after the 30th day. Refund request must be made within five calendar days of the 30th day anniversary of this contract. Please email refund@stellarhost.com for your refund request.
- StellarHost.Com shall invoice Purchaser on the 1st of each month for all recurring payments. Any non-recurring charges will be billed to Purchaser as needed. Payment is due when invoiced on the first of the month and is overdue on the 15th of the month. If paying by credit card, your card will be billed on the first of the month. If the card is returned invalid, you will be notified by email and have two weeks to submit a new credit card or check. Payment by check should be mailed to address on the invoice. StellarHost.Com has the option, without notice, to bill 1.5% per month or the maximum amount allowed by law, which ever is higher, on any charges that are not paid within the 15 day period. If payment is not received after 30 days, web site will be taken off line until payment is received in full.
- This contract will automatically renew for successive thirty (30) day periods (or twelve (12) month periods, depending on length of pre-payment) for the life of the contract until canceled in writing. After the first 30 days a canceled account will be canceled before the next payment is due and no more billing will occur nor will any payment be refunded, even for unused portions.
- Accounts are invoiced monthly. Payment is due when invoiced, with an overdue date specified in the invoice. Overdue accounts may be terminated or suspended at StellarHost.Com's discretion.
- StellarHost.Com may terminate service to the subscriber at any time, without notice, for violation of this agreement. StellarHost.Com will not be liable for any damages or harm to the account holder resulting from such termination.
- The account holder may terminate their account at any time. The request to terminate the account must be in writing. The account holder may send cancellation request via an email message to billing@stellarhost.com, by postal mail or by fax.
- The resale of StellarHost.Com products and services is not permitted, unless specifically permitted and documented in a written agreement.
- Use of a StellarHost.Com account indicates acceptance of the terms of this agreement by the account holder.
- This agreement shall be governed by and construed in accordance with the laws of Maryland. This agreement contains the full understanding of the parties with respect to the subject matter hereof. Any email correspondence with the account holder which is in any way inconsistent with, or which adds to, the provisions of this agreement is null and void.
